Terms of Service
Last updated: 19 October 2026 (draft, not legally reviewed)
1. Who we are and what this covers
PitLane Auctions (pitlaneauctions.app) and Garage (pitlaneauctions.app/garage) are run by Joar Løvik Njølstad, [email protected]. By creating an account or using the service you accept these terms and the privacy notice. If you do not accept them, do not use the service.
2. What the service is
PitLane is a marketplace where private and business sellers list collectible diecast cars (such as Hot Wheels) for sale, trade and auction. Garage is a tool for keeping track of your own collection. PitLane is an intermediary. We are not the seller or buyer in any trade, we do not own the items, and we do not check listings, prices or quality in advance. The contract for a trade is between the seller and the buyer.
3. Accounts
- You must be at least 18 to buy and sell on PitLane.
- The information you give must be correct. You are responsible for everything that happens on your account and for keeping your password secret.
- You can delete your account in Settings. See the privacy notice for what is removed.
- We cannot promise the service is always available. It is a small, privately run project.
4. Listing and conduct rules
You must not:
- list counterfeits, pirated goods or items you have no right to sell,
- give misleading information about an item's condition, authenticity or price,
- manipulate auctions (for example bidding through your own or friends' accounts to push up the price),
- upload images you have no right to use, or content that is illegal, abusive or harassing,
- try to avoid fees, or abuse, overload or hack the system.
You keep the rights to the photos and text you post, but you give us the right to display them in the service, in notifications and in promoting the service. PitLane may post listing photos, title, price and a link on PitLane's own social media accounts (such as Instagram and TikTok) to promote the listing and the service. You can ask support to remove a published post at any time.
5. Trades between seller and buyer
- A winning bid or an accepted deal is binding. The seller must ship the item as described and the buyer must pay.
- The seller is responsible for the item matching its description, for packing, shipping, answering the buyer and for refunds where appropriate.
- The buyer must pay on time and give a correct delivery address.
- Sellers are responsible for their own taxes and duties (income tax, VAT and similar) on their sales. If you are a business seller, withdrawal rights and other consumer rules apply towards consumer buyers.
- We may remove listings and limit or close accounts for breaking the rules, suspected fraud or on orders from authorities.
6. Payment with Stripe
Applies where payment through PitLane is available. The feature is being rolled out gradually and is not open to everyone.
- Payments are handled by Stripe. The seller creates a Stripe account and accepts Stripe's own terms. We do not see or store your card details.
- The buyer pays the seller directly. The money goes to the seller's Stripe account, not to PitLane. PitLane does not hold, manage or release the money. When and how the seller is paid out follows Stripe's rules for the seller's country and account, and can take several days.
- The seller adds shipping to the trade before the buyer pays. The buyer sees the total before paying.
- The buyer pays a service fee covering payment processing and PitLane's fee of 2 % of the item amount. The seller receives the item amount plus shipping. The fee is shown clearly before payment.
- The seller is the seller of record. Refunds, returns and card chargebacks are the seller's responsibility. The amount and any dispute fee can be deducted from the seller's Stripe balance.
- No buyer protection from PitLane. We offer no escrow and do not guarantee delivery or the condition of an item. The buyer's safety net is the deal with the seller, these rules, the card network's own rights and help from support.
7. Liability
The service is provided "as is". To the extent the law allows, we are not liable for losses arising in trades between users, for content users post, for the service being unavailable or faulty, or for indirect losses. This does not limit liability that cannot be limited under mandatory law, and does not limit your rights as a consumer.
8. Changes and termination
We may change the service and these terms. For material changes we will notify you in the service or by email. If you keep using the service after a change, you accept the new terms. You can stop using the service and delete your account at any time. We may close accounts that break the terms.
9. Governing law and disputes
Norwegian law applies. Disputes should first be raised with us at [email protected]. Mandatory consumer rights in your country of residence still apply. Consumers can also use the EU online dispute resolution platform (ec.europa.eu/consumers/odr).
